SUPER NICE HUB WEBSITE TERMS OF USE

These terms govern your use of supernicehub.com (the Site), operated by Black Elk Pty Ltd (ABN 49 681 755 591) (we, us). By using the Site you accept these terms. If you hold a merchant account, the Merchant Agreement also applies to you and prevails over these terms to the extent of any inconsistency.
1. WHAT THE SITE IS
The Site is a payments and client onboarding platform. Pages such as payment links, agreement signing and payment method setup are provided on behalf of the merchant named on the page. Any purchase, agreement or direct debit authority you enter into on those pages is between you and that merchant, not with us. We provide the technology and payment facilitation only, and we do not give legal, financial or tax advice through the Site.
2. ACCEPTABLE USE
You must not, and must not attempt to: (a) use the Site for any unlawful purpose or in breach of any law; (b) access accounts, data or pages you are not authorised to access; (c) probe, scan, or test the vulnerability of the Site, bypass security or authentication, or interfere with its operation; (d) use bots, scraping or automated access except through APIs we provide to you under an agreement; (e) submit false, misleading or fraudulent information, including card testing or transactions you are not authorised to make; (f) introduce malicious code; or (g) copy, frame or republish the Site or its content other than as needed to use it normally. We log security-relevant activity and may report unlawful conduct to authorities.
3. ACCOUNTS AND SIGNING
You are responsible for keeping your login credentials confidential and for activity under your account. Documents signed electronically through the Site (agreements, Direct Debit Requests) are intended to be legally binding under the Electronic Transactions Act 1999 (Cth). Only sign in your own name, or for an entity you are authorised to bind.
4. INTELLECTUAL PROPERTY
The Site, its design, code and content (other than content belonging to merchants or their clients) are owned by or licensed to us. We grant you a limited, revocable, non-transferable licence to use the Site for its intended purpose. Merchant and client data remains the property of its owner as described in the privacy policy and Merchant Agreement.
5. AVAILABILITY AND CHANGES
We work to keep the Site available and secure, but we do not guarantee uninterrupted or error-free operation, and we may change, suspend or discontinue features. We may update these terms at any time by posting the new version on this page; material changes for account holders are notified as described in the Merchant Agreement.
6. LIABILITY
Nothing in these terms excludes rights under the Australian Consumer Law that cannot be excluded. Subject to that, to the maximum extent permitted by law: the Site is provided as-is; we are not liable for indirect or consequential loss arising from use of the Site; and our total liability to a person who does not hold a paid account with us is limited to $100. Liability to merchants is governed by the Merchant Agreement.
7. GENERAL
Third party links and services (including the payment gateway pages) are governed by their own terms. These terms are governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of its courts. If part of these terms is unenforceable, the rest continues to apply.
